    A judge has tossed out a lawsuit against Marilyn Manson alleging that he sexually, psychologically and physically abused his ex-girlfriend.   Ashley Morgan Smithline claimed Manson, whose real name is Brian Hugh Warner, committed the allege abuse against her during their two-year relationship that began in 2010. Smithline's case was dismissed without prejudice yesterday after the model fired her lawyer, and then failed to meet the deadline to obtain representation in court.     Delegate Elizabeth Guzman (D-Prince William) is working to introduce legislation that could make it child abuse or neglect for parents to not affirm their child’s sexual identity or gender orientation, according to a Thursday report from WJLA. That proposal triggered widespread criticism on Friday, and Guzman later criticized WJLA’s reporting. “My bill will state in the Code of Virginia that bullying a child from the LGBTQ community, and this includes mental or physical abuse, to be abused for their sexual orientation or gender identity, that would be considered a Child Protective Services charge,” Guzman said in a video of the WJLA interview. Westchester County resident Jonitha Alston, age 35, of New Rochelle, will be freed after acting State Supreme Court Justice Robert Neary vacated her original 12-year sentence and resentenced her to five years in prison. The move followed a recommendation from Westchester County District Attorney Miriam Rocah for a reduced sentence under New York’s 2019 Domestic Violence Survivors Justice Act (DVSJA). The law allows for shorter sentences in cases where a defendant has suffered sexual, psychological, or physical abuse that significantly contributed to their criminal conduct. In February 2017, a Westchester County grand jury charged Alston with second-degree murder in the death of Dennis Graham in December 2016.     OAKLAND — At the verge of her trial’s beginning, a San Leandro woman pleaded no contest to multiple felony contest related to extensive abuse of her then-9-year-old son, whom authorities say was starved, received regular beatings, and spent most of his time locked in a bathroom. Shawanda Black, 27, pleaded no contest to mayhem, multiple counts of inflicting injury on a child, and assault, according to court records. In return, prosecutors dropped numerous other charges, including torture, which would have made her eligible for a life sentence. Black will receive an 18-year prison term, scheduled to be handed down in August, court records show. She entered her plea as jury selection was underway in her trial. Black has been in jail since January 2020, when she was arrested and charged. She will receive credit for the two years she has spent behind bars. Several medical groups have warned that pandemic isolation from school closures and lack of social gatherings has taken a toll on young people’s mental health. “This really gives us the evidence to say with certainty that the pandemic was incredibly disruptive for young people and their families,” said Kathleen Ethier of the Centers for Disease Control and Prevention. The reports are based on anonymous online surveys of about 7,700 public and private high school students from 128 schools during the first six months of 2021.     The family of a New York City man who died last year while being held in solitary confinement at Rikers Island after being unable to post $1,000 bail filed a lawsuit on Monday blaming the city for killing the 27-year-old through its own negligence. At roughly 9:30 a.m. on Oct. 9, 2020, Christopher M. Cruz was found unresponsive in his cell at Rikers’ Anna M. Kross Center, a sprawling facility for male pre-trial detainees. He was pronounced dead 45 minutes later. According to a copy of the suit obtained by The Daily Beast, Cruz suffered from asthma and schizophrenia. However, the Rikers staff refused to provide Cruz “with a reasonable accommodation for his disability,” which led directly to his death, alleges the filing, which does not specify precisely how Cruz died.     Allegations of abuse at a state-run youth detention center in New Hampshire date back 60 years, reported the Associated Press (AP) on Monday. The accusations of physical or sexual abuse involve 230 minors and 150 staff members of the Youth Development Center in Manchester, according to court documents reviewed by the AP. The case began in January of 2020, when three dozen plaintiffs sued New Hampshire alleging abuse at the center from dates ranging from 1982 to 2014, the AP reported. Rus Rilee, the attorney for those original plaintiffs, now represents 230 individuals who claim they were abused at various points in the youth detention center’s history, according to the AP.
